Terms and Conditions

We reserve the right to change these Terms from time to time. Any changes to these terms will take effect immediately and shall be notified to you.

Tuition is only available to persons who meet the following criteria:* Aged 17 or over, or aged 16 or over and in receipt of or have applied for the enhanced rate of the mobility component of Personal Independence Payment (PIP), or in receipt of the higher rate of Disability Living Allowance (mobility component); and* hold a valid UK provisional driving licence; and* legally entitled to drive in the UK.

Your driving instructor will ask that you sign a copy of the Terms & Conditions form. Signing the Terms & Conditions form shows agreement and understanding of the terms and conditions entailed in taking driving lessons with your New Era Driving School driving instructor.

Please note that payments can only be made via bank transfer or cash your debit card details will not be kept by our Bookings Team as these will be used to take the single payment and will not be stored in any way whatsoever. The student should be aware that  New Era Driving School offers a no refund policy on block bookings, all hours must be used. New Era Driving School takes no responsibility for any payments made by the Student directly to the instructor, as these monies are not paid to New Era Driving School. The Student certifies that a valid suitable licence is held to drive the tuition vehicle. Students must inform their instructor immediately if they receive any endorsements on their licence during the period they are receiving tuition.

In the event of mechanical breakdown or other difficulties outside the control of the instructor, the instructor reserves the right to rearrange lessons at short notice. A minimum of 48 hours notice is required to be given to the instructor by the student to cancel a lesson and should the Student fail to give such short notice the Student may be liable to pay the full tuition fee. A lesson is of one hour, one and half hours or two hours duration. If for any reason outside the Instructors control it is not possible to give a full hours instruction, then any lost time will be added to a later lesson. It is the responsibility of the student to ensure that this is noted.

The price paid for the driving test fee does not include the use of the car for the purpose of the test and any prior instruction. Therefore, current rates will apply. All payments must be made payable to the instructor and will only be accepted with cash or bank transfer. Payment for each hour of instruction should be made prior to the lesson. New Era Driving School reserves the right to change the hourly rate with reasonable prior notice to the student. All lessons taken after any special offer will be charged at £40 per hour also an extra £2.00 per hour extra evenings after 5 pm or weekends for a manual car and for a automatic car £42 per hour with the £2.00 extra per hour evenings after 5pm or weekends.

The total cost of “Pass Plus” – Minimum of 6 hours is £250.00.

 

Legal Liability

The student should be aware that the instructors primary objective is to promote road safety and in doing so, he/she may take control of the vehicle. The instructor will make every effort to instruct the student to the highest standard but can in no way be held liable for any errors that the student may make whilst driving and not accompanied by the instructor either before or after a test pass. The instructor will endeavour to teach the student the correct driving skills according to the recommended syllabus issued by the DVSA within the minimum number of lessons required. Driving Tests may only be arranged with the prior agreement of both the instructor and the student. Any complaints are to be dealt with in accordance with the ADI Code of Practice. The instructor is at liberty at his/her absolute discretion to refuse to proceed with a lesson if he or she has reason to believe that the student is in any way under the influence of drink or drugs at the time of the lesson. The instructor will accept no liability for accidents, injury or damage to any third party caused by the student’s recklessness or negligence during a lesson. The instructor reserves the right to withhold the use of his/her vehicle for a driving test.

You and Your Instructor are responsible for agreeing on all matters relating to the timing, location and duration of individual lessons. You must notify Your Instructor of any matters which affect your ability or entitlement to have driving tuition, for example, but not limited to, any lack, or loss, of a valid UK provisional driving licence.

 

Cancellation of Lessons

If You or Your Instructor wish to cancel a lesson a minimum of 48 hours’ prior notice should be given. If Your Instructor cancels a lesson without giving this minimum period of notice Your Instructor shall rearrange the lesson. Cancellations made by You must be made through the Customer Services or directly between You and Your Instructor. Please note that the Customer Service is not open on Sundays. Cancellation requests cannot be actioned outside of office hours. If you do not give at least 48 hours’ notice of cancellation You will be charged for the lesson(s) concerned in full. In the event of you having booked your driving test, the Driver and Vehicle Standards Agency (DVSA) requires you to give three clear working days to cancel your test. This may mean that you may lose your DVSA test fee if your instructor says you are not ready for your test within this three-day notice period.

 

Payments and Lesson Bookings

You must pay for any tuition at least 48 hours before the start of the lesson. Please note that the Customer Service is not open on Sundays. Payments cannot be taken outside office hours. You can use one of the following methods of payment: 1. Payment by cash (for initial lesson Purchases only); 2. Payment by bank transfer or by validating a New Era Driving School voucher or gift card by telephoning the New Era Driving School Customer Services line on +44 07983 666 855.* A booking fee, as notified to you prior to the transaction, will be charged on the purchase of your initial lesson package online or through our New Era Driving School Customer Services line on +44 07983666855.* Voucher and gift cards have no cash value and have to be redeemed against tuition.* Voucher and gift cards are not transferable once they have been redeemed.* New Era has no responsibility or liability to You for payments made by any other means. If You pay Your Instructor directly by any method, You should obtain a receipt. New Era Driving School accepts no responsibility for any payments made directly to instructors.

 

Price Changes

The cost of prepaid tuition is based on the lesson price in force at the time of booking and with the exception of the circumstances set out below, will be honoured for 6 months thereafter irrespective of any price increase that may occur between the date of booking and when the lessons are taken. Any unused lessons remaining after 6 months have elapsed shall have any lesson price increase applied prior to the lessons which shall become payable by You. Circumstances where, if You have prepaid, You will be either be required to pay an additional amount beyond the cost of Your pre-paid lessons or receive a refund of some of Your prepayments (as applicable):* Where You have moved postcode and no longer wanting driving lessons you will be refunded difference, provided it is within a 6 months period from the date of purchase.
